1. About these terms
These Terms of Service ("Terms") govern your use of theharvest-shop.com (the "Site") and any purchase made through it. By placing an order, browsing, or creating an account, you agree to be bound by these Terms. If you do not agree, do not use the Site.
2. Eligibility
You must be at least 18 years old, or have the consent of a parent or legal guardian, to place an order. By purchasing from us, you confirm the information you provide is accurate and that you have the legal authority to enter into this agreement.
3. Products and pricing
• All prices are listed in South African Rand (ZAR) and include VAT where applicable, unless stated otherwise.
• We reserve the right to change prices, descriptions, and availability of any product at any time without prior notice.
• We make reasonable efforts to display product colours and details accurately, but we do not guarantee that your device's display will show exact colours.
• In the event of a pricing error, we reserve the right to cancel the order and refund any amount paid, even after order confirmation.
4. Orders and acceptance
• Placing an order is an offer to purchase; it is not accepted until we send you a confirmation of dispatch.
• We reserve the right to refuse or cancel any order for any reason, including suspected fraud, pricing errors, or stock unavailability.
• If we cancel a paid order, you will receive a full refund to your original payment method.
5. Payment
• Full payment is required at the time of order. We do not offer layby, partial payment, or invoicing to individual customers unless separately agreed in writing.
• You warrant that any payment method used is your own or that you are authorised to use it.
• We are not responsible for delays or failures caused by your bank, card issuer, or payment provider.
6. Shipping and delivery
• Delivery timeframes provided at checkout are estimates only and are not guaranteed.
• Risk in the goods passes to you upon delivery to the address provided at checkout. It is your responsibility to ensure the delivery address and contact details are correct.
• We are not liable for delays caused by couriers, customs, weather, or events outside our reasonable control.
• Failed deliveries due to incorrect address information provided by you may incur additional shipping charges.
7. Returns and refunds
Returns and refunds are governed by our separate Returns & Refunds Policy, available at theharvest-shop.com/policies/refund-policy. By purchasing from us, you agree to its terms.
8. Intellectual property
All content on the Site — including text, images, logos, graphics, and product photography — is owned by or licensed to The Harvest and is protected by copyright and trademark law. You may not copy, reproduce, distribute, or use any content from the Site for commercial purposes without our prior written consent.
9. User accounts

• You must notify us immediately of any unauthorised use of your account.

Nothing in this section limits liability that cannot lawfully be excluded, including liability for gross negligence or for defective products under the Consumer Protection Act 68 of 2008.

You agree to indemnify and hold harmless The Harvest, its owners, and employees from any claim, loss, or damage arising from your breach of these Terms or misuse of the Site.
